Best Stay Travels Terms of Service

When these Terms mention “Best Stay Travels,” “we,” “us,” or “our,” it refers to the Best Stay Travels company you are contracting with. Your contracting entity will generally be determined based on your country of residence or establishment.

Scope of Best Stay Travels Services
The Best Stay Travels Platform is an online marketplace that enables registered users (“Members”) and certain third parties who offer services (Members and third parties who offer services are “Hotel or Properties” and the services they offer are “Hotel or Property Services”) to publish such Hotel or Property Services on the Best Stay Travels Platform (“Listings”) and to communicate and transact directly with Members that are seeking to book such Hotel or Property Services (Members using Hotel or Property Services are “Guests”). Hotel or Property Services may include the offering of vacation or other properties for use (“Accommodations”), single or multi-day activities in various categories (“Experiences”), access to unique events and locations (“Events”), and a variety of other travel and non-travel related services.

As the provider of the Best Stay Travels Platform, Best Stay Travels does not own, create, sell, resell, provide, control, manage, offer, deliver, or supply any Listings or Hotel or Property Services, nor is Best Stay Travels an organizer or retailer of travel packages under Directive (EU) 2015/2302. Hotel or Properties alone are responsible for their Listings and Hotel or Property Services. When Members make or accept a booking, they are entering into a contract directly with each other. Best Stay Travels is not and does not become a party to or another participant in any contractual relationship between Members, nor is Best Stay Travels a real estate broker or insurer. Best Stay Travels is not acting as an agent in any capacity for any Member, except as specified in the Payments Terms.

While we may help facilitate the resolution of disputes, Best Stay Travels has no control over and does not guarantee (i) the existence, quality, safety, suitability, or legality of any Listings or Hotel or Property Services, (ii) the truth or accuracy of any Listing descriptions, Ratings, Reviews, or other Member Content (as defined below), or (iii) the performance or conduct of any Member or third party. Best Stay Travels does not endorse any Member, Listing, or Hotel or Property Services. Any references to a Member being “verified” (or similar language) only indicate that the Member has completed a relevant verification or identification process and nothing else. Any such description is not an endorsement, certification, or guarantee by Best Stay Travels about any Member, including the Member’s identity or background or whether the Member is trustworthy, safe, or suitable. You should always exercise due diligence and care when deciding whether to stay in an Accommodation, participate in an Experience or Event or use other Hotel or Property Services, accept a booking request from a Guest, or communicate and interact with other Members, whether online or in person. Verified Images (as defined below) are intended only to indicate a photographic representation of a Listing at the time the photograph was taken, and are therefore not an endorsement by Best Stay Travels of any Hotel or Property or Listing.

If you choose to use the Best Stay Travels Platform as a Hotel or Property or Co-Hotel or Property (as defined below), your relationship with Best Stay Travels is limited to being an independent, third-party contractor, and not an employee, agent, joint venturer or partner of Best Stay Travels for any reason, and you act exclusively on your own behalf and for your own benefit, and not on behalf, or for the benefit, of Best Stay Travels. Best Stay Travels does not, and shall not be deemed to, direct or control you generally or in your performance under these Terms specifically, including in connection with your provision of the Hotel or Property Services. You acknowledge and agree that you have complete discretion on whether to list Hotel or Property Services or otherwise engage in other business or employment activities.

To promote the Best Stay Travels Platform and to increase the exposure of Listings to potential Guests, Listings and other Member Content may be displayed on other websites, in applications, within emails, and in online and offline advertisements. To assist Members who speak different languages, Listings and other Member Content may be translated, in whole or in part, into other languages. Best Stay Travels cannot guarantee the accuracy or quality of such translations and Members are responsible for reviewing and verifying the accuracy of such translations. The Best Stay Travels Platform may contain translations powered by Google. Google disclaims all warranties related to the translations, express or implied, including any warranties of accuracy, reliability, and any implied warranties for merchantability, fitness for a particular purpose, and non-infringement.

The Best Stay Travels Platform may contain links to third-party websites or resources (“Third-Party Services”). Such Third-Party Services may be subject to different terms and conditions and privacy practices. Best Stay Travels is not responsible or liable for the availability or accuracy of such Third-Party Services, or the content, products, or services available from such Third-Party Services. Links to such Third-Party Services are not an endorsement by Best Stay Travels of such Third-Party Services.

Due to the nature of the Internet, Best Stay Travels cannot guarantee the continuous and uninterrupted availability and accessibility of the Best Stay Travels Platform. Best Stay Travels may restrict the availability of the Best Stay Travels Platform or certain areas or features thereof if this is necessary in view of capacity limits, the security or integrity of our servers, or to carry out maintenance measures that ensure the proper or improved functioning of the Best Stay Travels Platform. Best Stay Travels may improve, enhance, and modify the Best Stay Travels Platform and introduce new Best Stay Travels Services from time to time.

Modification of these Terms
Best Stay Travels reserves the right to modify these Terms at any time in accordance with this provision. If we make changes to these Terms, we will post the revised Terms on the Best Stay Travels Platform and update the “Last Updated” date at the top of these Terms. We will also provide you with notice of the modifications by email at least thirty (30) days before the date they become effective. If you disagree with the revised Terms, you may terminate this Agreement with immediate effect. We will inform you about your right to terminate the Agreement in the notification email. If you do not terminate your Agreement before the date the revised Terms become effective, your continued access to or use of the Best Stay Travels Platform will constitute acceptance of the revised Terms.

 

Account Registration
You must register an account (“Best Stay Travels Account”) to access and use certain features of the Best Stay Travels Platform, such as publishing or booking a Listing. If you are registering a Best Stay Travels Account for a business, organization, or other legal entity, you represent and warrant that you have the authority to legally bind that entity, and grant us all permissions and licenses provided in these Terms.

You can register a Best Stay Travels Account using an email address and creating a password, or through your account with certain third-party social networking services, such as Facebook or Google (“SNS Account”). You have the ability to disable the connection between your Best Stay Travels Account and your SNS Account at any time, by accessing the “Settings” section of the Best Stay Travels Platform.

You must provide accurate, current, and complete information during the registration process and keep your Best Stay Travels Account and public Best Stay Travels Account profile page information up-to-date at all times.

You may not register more than one (1) Best Stay Travels Account unless Best Stay Travels authorizes you to do so. You may not assign or otherwise transfer your Best Stay Travels Account to another party.

You are responsible for maintaining the confidentiality and security of your Best Stay Travels Account credentials and may not disclose your credentials to any third party. You must immediately notify Best Stay Travels if you know or have any reason to suspect that your credentials have been lost, stolen, misappropriated, or otherwise compromised or in case of any actual or suspected unauthorized use of your Best Stay Travels Account. You are liable for any and all activities conducted through your Best Stay Travels Account unless such activities are not authorized by you and you are not otherwise negligent (such as failing to report the unauthorized use or loss of your credentials).

Best Stay Travels may enable features that allow you to authorize other Members or certain third parties to take certain actions that affect your Best Stay Travels Account. For example, we may enable Members to link their Best Stay Travels Accounts to businesses and take actions for those businesses, we may enable eligible Members or certain third parties to book Listings on behalf of other Members, or we may enable Hotel or Properties to add other Members as Co-Hotel or Properties (as defined below) to help manage their Listings. These features do not require that you share your credentials with any other person. No third party is authorized by Best Stay Travels to ask for your credentials, and you shall not request the credentials of another Member.

1. Terms
By accessing the website at http://beststaytravels.com, you are agreeing to be bound by these terms of service, all applicable laws, and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. Use License
Permission is granted to temporarily download one copy of the materials (information or software) on Best Stay Travels’ website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license, you may not: modify or copy the materials; use the materials for any commercial purpose, or for any public display (commercial or non-commercial); attempt to decompile or reverse engineer any software contained on Best Stay Travels’ website; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or “mirror” the materials on any other server. 4. Limitations
In no event shall Best Stay Travels or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Best Stay Travels’ website, even if Best Stay Travels or a Best Stay Travels authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Best Stay Travels may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

8. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Airport Industrial Park, Nassau, N.P., Bahamas and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

Interpretation and Definitions

Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions.

For the purposes of this End-User License Agreement:

Agreement means this End-User License Agreement that forms the entire agreement between You and the Company regarding the use of the Website. This Agreement has been created with the help of the EULA Generator.

Website means the software program provided by the Company downloaded by You to a Device, named Best Stay Travels

Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Best Stay Travels , Airport Industrial Park, N.P., Bahamas.

Content refers to content such as text, images, or other information that can be posted, uploaded, linked to or otherwise made available by You, regardless of the form of that content.

Country refers to: Bahamas

Device means any device that can access the Website such as a computer, a cellphone or a digital tablet.

Third-Party Services means any services or content (including data, information, Websites, and other products services) provided by a third-party that may be displayed, included or made available by the Website.

You means the individual accessing or using the Website or the company, or other legal entity on behalf of which such individual is accessing or using the Website, as applicable.

Acknowledgment
By clicking the “I Agree” button, downloading or using the Website, You are agreeing to be bound by the terms and conditions of this Agreement. If You do not agree to the terms of this Agreement, do not click on the “I Agree” button, do not download or do not use the Website. This Agreement is a legal document between You and the Company and it governs your use of the Website made available to You by the Company. The Website is licensed, not sold, to You by the Company for use strictly in accordance with the terms of this Agreement.

License
Scope of License
The Company grants You a revocable, non-exclusive, non-transferable, limited license to download, install and use the Website strictly in accordance with the terms of this Agreement.

The license that is granted to You by the Company is solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.

Third-Party Services
The Website may display, include or make available third-party content (including data, information, Websites and other products services) or provide links to third-party websites or services. You acknowledge and agree that the Company shall not be responsible for any Third-party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect thereof. The Company does not assume and shall not have any liability or responsibility to You or any other person or entity for any Third-party Services. You must comply with applicable Third parties’ Terms of agreement when using the Website. Third-party Services and links thereto are provided solely as a convenience to You and You access and use them entirely at your own risk and subject to such third parties’ Terms and conditions.

Term and Termination
This Agreement shall remain in effect until terminated by You or the Company. The Company may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice. This Agreement will terminate immediately, without prior notice from the Company, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Website and all copies thereof from your Device or from your computer.

Upon termination of this Agreement, You shall cease all use of the Website and delete all copies of the Website from your Device. Termination of this Agreement will not limit any of the Company’s rights or remedies at law or in equity in case of breach by You (during the term of this Agreement) of any of your obligations under the present Agreement.

Indemnification
You agree to indemnify and hold the Company and its parents, subsidiaries, affiliates, officers, employees, agents, partners, and licensors (if any) harmless from any claim or demand, including reasonable attorneys’ fees, due to or arising out of your: (a) use of the Website; (b) violation of this Agreement or any law or regulation; or (c) violation of any right of a third party.

No Warranties
The Website is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Website, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking and makes no representation of any kind that the Website will meet your requirements, achieve any intended results, be compatible or work with any other software, Websites, systems, or services, operate without interruption, meet any performance or reliability standards or be error-free or that any errors or defects can or will be corrected. PAYMENT & CANCELLATION POLICY
If applicable and available, certain Suppliers offer the opportunity for bookings to be paid (wholly or partly and as required under the payment policy of the Supplier) to the Supplier during the bookings process, by means of secure online payment (all to the extent offered and supported by your bank). For certain products and services, Beststaytravels.com facilitates (through third-party payment processors) the payment of the relevant product or service for and on behalf of the Supplier (Beststaytravels.com never acts nor operates as the merchant of record). Payment may also be accepted by the Supplier (e.g. pay at the hotel). Payment is safely processed from your credit/debit card or bank account to the bank account of the accommodation provider through a third party payment processor. Any payment facilitated by us for and on behalf of, and transferred to the Supplier will in each case constitute a payment of (part of) the booking price by you of the relevant product or service in final settlement) of such (partial) due and payable price and you cannot reclaim such paid monies.

Payment may be seen on your account as a charge from Hospitality Group Ltd. or Hospitality Mrktg & Mngmt Sol.

For certain (non-refundable) rates or special offers, note that Suppliers may require that payment be made upfront by wire transfer (if available) or by credit card, and therefore your credit card may be pre-authorized or charged (sometimes without any option for refund) upon making the bookings. Check the (reservation) details of your product or service of choice thoroughly for any such conditions prior to making your bookings. You will not hold Beststaytravels.com liable or responsible for any (authorized, (allegedly) unauthorized or wrong) charge by the Supplier and not (re)claim any amount for any valid or authorized charge by the Supplier (including for pre-paid rates, no-show, and chargeable cancellation) of your credit card. In the event of credit card fraud or unauthorized use of your credit card by third parties, most banks and credit card companies bear the risk and cover all charges resulting from such fraud or misuse, which may sometimes be subject to a deductible rate in your bank’s currency.

In the event that your credit card company or bank charges the deductible from you due to unauthorized transactions resulting from a reservation made on our Platform, we will pay you this deductible, up to an aggregate amount of USD 75 (or the equivalent in your local currency). In order to indemnify you, please report fraud to your credit card provider (in accordance with its reporting rules and
procedures) and contact us immediately. Please provide us with evidence of the charged deductible (e.g. policy of the credit card company). This indemnification only applies to credit card reservations made using Beststaytravels.com’s secure server and the unauthorized use of your credit card resulting through our default or negligence and through no fault of your own while using the secure server.

By making a booking with a Supplier, you accept and agree to the relevant cancellation and no-show policy of that Supplier, and to any additional (delivery) terms and conditions of the Supplier that may apply to your booking (including the fine print of the Supplier made available on our Platform and the relevant house rules of the Supplier), including for services rendered and/or products offered by the Supplier. The relevant (delivery/purchase/use/carrier) terms and conditions of a Supplier can be obtained with the relevant Supplier. The general cancellation and no-show policy of each Supplier is made available on our Platform on the Supplier information pages, during the reservation procedure, and in the confirmation email or ticket (if applicable). Note that certain rates, fees, or special offers are not eligible for cancellation, refund, or change. Check the (reservation) details of your product or service of choice thoroughly for any such conditions prior to making your reservation. Note that a booking which requires down payment or (wholly or partly) prepayment may be canceled (without prior notice of default or warning) insofar the relevant (remaining) amount(s) cannot be collected in full on the relevant due or payment date in accordance with the relevant payment policy of the Supplier and the reservation. Cancellation and prepayment policies may vary per segment, product, or service of each Trip. Late payment, wrong bank, debit or credit card details, invalid credit/debit cards, or insufficient funds are for your own risk and account, and you will not be entitled to any refund of any (non-refundable) prepaid amount unless the Supplier agrees or allows otherwise under its (pre)payment and cancellation policy.

If you want to review, adjust, or cancel your bookings, revert to the confirmation email and follow the instructions therein. Note that you may be charged for your cancellation in accordance with the Supplier’s cancellation, (pre)payment, and no-show policy, or not be entitled to any repayment of any (pre)paid amount. We recommend that you read the cancellation, (pre)payment, and no-show policy of the accommodation provider carefully prior to making your reservation, and remember to make further payments on time as may be required for the relevant reservation. If you have a late or delayed arrival on the check-in date or only arrive the next day, make sure to (timely/promptly) communicate this with the Supplier so they know when to expect you to avoid cancellation of your booking or charge of the no-show fee. Our customer service department can help you if needed by informing the Supplier. Beststaytravels.com does not accept any liability or responsibility for the consequences of your delayed arrival or any cancellation or charged no-show fee by the Supplier.

These terms and conditions (the “Agreement”) describe what you are legally entitled to expect from us when you purchase travel related services through us, in addition to your obligations as a customer. The terms “we”, “us” and “our” refer to Best Stay Travels Ltd. The term “you” refers to the customer visiting our website, booking a reservation through us, or otherwise using our services.

1. Our Agreement With You
Products and Suppliers
We sell a variety of travel-related products from different suppliers and service providers (“Suppliers”). Each Supplier has its own terms and conditions that are applicable to your particular arrangements in addition to our general terms and conditions, and you should make sure you understand them. Certain software and content found on our website are owned or licensed by us or our Suppliers, your use of which may be subject to further conditions. Our website, which is referred to throughout this Agreement, can be found at www.beststaytravels.com.
Best Stay Travels is acting as an intermediary or a “Booking Agent” for products and services that are not directly supplied by us for example airfare, hotel bookings, activity bookings, transportation, and other reservations. We are not a co-vendor of such products and services. You will be entering into a separate contract with such Suppliers in connection with such products and services.

Deposits and Payment 

Any deposits from you are non-refundable. The payment of a deposit enables us to hold a reservation for you but does not guarantee the price. The price can only be guaranteed once we receive full payment and other travel documents have been issued, subject to any terms and conditions of the Supplier. We will advise you of the date that full payment is required. Upon the provision of your payment information, you are authorizing us to make the payment arrangements with the corresponding Suppliers. After full payment, the conditions of the contract with your Supplier may permit them to increase the cost of your arrangements. If we are acting as your Booking Agent, we will pass on any such increase to you as we become aware of such an increase. If we have arranged a package, changes in transportation costs including the cost of fuel, taxes, fees, and exchange rates mean that the price of your travel arrangements may change after you have paid in full. Cancellations and Changes
Your contract with your Suppliers may allow them to cancel or amend bookings. If we are your Booking Agent, we will ensure that you are promptly notified of any significant changes once we become aware of such change if there is time before your departure, but we accept no liability for any changes or costs incurred that may result. Subject to the Supplier’s terms and conditions, you will then have the choice of accepting the change of arrangements, accepting an offer of alternative travel arrangements if one is made available by the Supplier, or canceling your booked arrangements and receiving any applicable refunds. We do not guarantee that any refunds will apply.
Your Acceptance of these Terms and Conditions
By booking your arrangement with us or using our website, you are agreeing to be bound by the terms of this Agreement, including Parts 1-3 of this Agreement and any additional terms and conditions of any Supplier that are applicable to your booking, travel arrangements, or use of any website content. You agree on behalf of yourself and those you represent to comply with all such terms and conditions, including the payment of all amounts when due. You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, (c) you being denied access to the applicable travel-related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation. You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you or members of your group is true and correct. You are responsible for informing such other persons of all terms and conditions applicable to their travel arrangements. You understand that you are financially responsible for any use of our services or website by you and those using your name or account.

If You Change Your Booking
Where a change requested by you to your travel arrangements is permitted and possible, our standard service fees will apply in addition to any additional Supplier charges. Please contact your original booking agent to enquire about changes or review the ‘Help’ or ‘FAQ’s section of www.beststaytravels.com for details of how to request changes. Please note that all reservation changes are subject to availability and the terms and conditions of the product purchased. Changes to name details are not allowed by many hotels and other Suppliers. While we will endeavor to make such a change if necessary, please bear in mind that most hotels and Suppliers treat a name change as a cancellation, to which standard conditions and charges would apply.

If You Cancel Your Booking
If you cancel your arrangements, you may be entitled to a partial refund. In addition to the cancellation terms and conditions of your Supplier(s), our standard fees will apply as may be outlined on your receipt or booking confirmation. We need to receive from you your original voucher before any applicable refund can be considered. If you decide to cancel arrangements before the balance due date, any deposits paid are non-refundable. Refunds will only be paid to you once we have received the funds back from the Supplier(s).

If You Have A Complaint
If you have a problem during your holiday, please inform the relevant Supplier (e.g. your hotel) immediately. Should they be unable to resolve the matter, please immediately contact us in The Bahamas, either through the office where you made your arrangements or through www.beststaytravels.com. If you fail to timely contact us, we will not be permitted the opportunity to investigate your complaint and attempt to rectify any error while you are away.

Travel Documents and Destinations
It is your responsibility to ensure that all of the details on your travel documents are correct and to bring to our attention any errors or discrepancies immediately. Your travel documents are valuable and should be safeguarded as if they were cash. It is not always possible to replace travel documents in case of loss, theft, damage, etc. Prior to booking international travel, we recommend that you review any U.S. Government’s prohibitions, warnings and advisories applicable to your destinations. By offering travel to any particular destination, we do not represent that travel in such a destination is safe or without risk.

Passport, Visa and Immigration Requirements
It is your responsibility to fulfill the passport, visa, and other immigration requirements applicable to your itinerary. You should confirm these with the relevant embassies and/or consulates. We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements.

Insurance
Travel insurance is a vital part of your arrangements. We strongly recommend that you have taken out adequate insurance for the duration of your journey. Travel insurance is a mandatory element of some travel arrangements. We may be able to arrange travel insurance to be provided to you, furnish you a quote, and answer any queries you may have regarding the insurance.

Travel Advice and Vaccinations
U.S. Citizens should refer to the travel advice posted by the U.S. Department of State at travel.state.gov for all the countries you intend to visit. Vaccinations may be required for some or all of the places you are intending to visit. It is your responsibility to ensure that you have arranged all necessary vaccinations for your itinerary.

Use of our Services and Website
You agree you will only use our website or services to make legitimate reservations or purchases and shall not make speculative, false, or fraudulent reservations or reservations in anticipation of demand. You will only use our website and services in compliance with applicable law. Beststaytravels.com disclaims any liability or responsibility for any communication by or with the Supplier on or through its platform. You cannot derive any rights from any request to, or communication with the Supplier or (any form of) acknowledgment of receipt of any communication or request.
